Starting a Business from Home

Working from home can be an appealing concept: no worries about fancy dress or a stressful commute. However, there are a few legal matters, as well as insurance and tax issues, of which you should be aware.

The first issue is zoning. Your town or city most likely designates certain space for industry, commercial, or residential use. It is important to contact your local zoning office to inquire if your business will be permitted given the location where you live. The quieter the business is, the more likely it is that it will be approved. The zoning office will be wary of any businesses which have a high amount of visibility, noise, smells, signs, traffic, or a large number of employees.

If your live in a condo or rent from an apartment there is likely documentation which dictates what activity may occur on the premise. This documentation will likely deter the use of property for a business. You still may be able to gain permission to work out of your home as long as it will not disturb the neighbors.

By working out of your home, you might be able to deduct the expenses of your home office if it meets the Internal Revenue Service requirements. However, the IRS is particular. It is recommended that a lawyer be consulted before using your home office as a deduction to be sure that the deduction will be upheld.
